What is UAE Ban?

Ban is a legal mechanism that prevents employee or residents from re-entering the same country or a person who served ban is will be unable to work or live in specific Country.

Types of Ban in UAE:

There are Two Types of Ban in United Arab Emirates.
1: Immigration Ban
2: Labour Ban, Employment Ban or Work permit Ban

What is UAE Immigration Ban?

All countries except UAE and GCC nationals need permission for the Government of UAE (Ministry of Immigration) to enter in UAE or any part of UAE, as each Emirate of UAE has their own Immigration section with different rules and regulations.

Losing a case in any emirates of UAE against your employer (Company), leaving a Government Job before completing your Limited labour Contract or Violation of Terms and Conditions of your Labour Contract will put 1 year ban on you and you will not allowed to visit UAE until you finish 1 year Labour ban.

    3. i worked in a company for 11 months then i resigned. I didnt have any serious offences just i didnt complete my contract. they banned me in ministry of labor and also in immigration for 1 year. will i be able to come after my bann period finish.

    4. I had immigration ban for the same reason as you. I left UAE for 1 year, next day after completing the ban I applied for visit visa and came back to UAE . Now I'm on employment visa and everything is ok. So don't worry , just wait till you ban period will be finished

  10. Hi I worked 2 years in Dubai since 2011-2013 but after my 2nd vacation I did not go back, i did not pass resignation letter to my company. I had bank loan too but i did not settle the remaining balance? Am I banned to enter UAE? even transit? Would you have any idea too If I can get police clearance from Dubai because of -that case?

    1. Yes you are banned and can not enter UAE and all GCC countries.
      The only way to remove ban is to contact the same company owners and request them to remove my ban, other wise if you entered UAE you will be arrested due to the case you mentioned and then you can not leave until you return full money to bank, and in prison you have to arrange lawyer for you to arrange everything for you because you will not be allowed to go out.

  11. I was given a Salary Increment proposal signed by our managing director when i had decided to join another company. to prevent be of going out, they had offer me this and i have accepted. I only find out later that my salary status is not updated nor submitted to labor and i am still receiving the same old salary amount. They had given me 1 month in addition of my salary by petty cash but up to this date, I should receive 7 months more. Day to day they are promising to give but when we don't know. Is there any way that i can get or avail of what they have proposed me preventing to exit in this company?

    1. Go to MOL Employment Department, As per the UAE employment law employees are not responsible for the company's financial liabilities and profit or loss. They are only responsible for their duties as agreed up on by the company in their employment contracts. If they fulfill their obligations as mentioned in their employment contracts, then, it is their right to receive their remuneration.

  16. Sir, I am a doctor with a master degree and fellowship. I work with same employer since Dec 2009 on 3 then 2 years limited contracts .My contract was renewed in April 15 for 2 more years.
    I spent more than 5 years on renewable limited contracts. I found another job , can employer put a ban ? I served them for over than 5 years. This doesn't count when I want to resign from the currently renewed limited contract. ? Sincere regards.

    1. No dear, MOL didn't count previous contract days, they just follow the new contracts.
      No it's depend on your company they shall cooperate with you, but if you want to leave job our suggestion will be for you to join free zone companies, you will be free from any sort of ban there.

  19. hi,its about my friend ,his visa term finished 2013 , he was told he had fines due to non application of the labour card , he filed a case against the company , he just finished his case with the company he was working , the company had closed 1 year ago and he wanted cancellation without the company sponsor . He got a 1 year ban from the labor and exited the country after immigration cancellation . My question is , will he be able to come back to the UAE on a visit or tourist visa after 1 or 2 months from the date of his exit from the UAE, since he still has a labour ban , and maybe find work in a free zone company?

    1. NO no one can put ban on you, after completing your contract you will be free for 1 month to get your job, and free zone is the best place for work, no ban will be on you even if you cancel the visa before contract.

If so what is the case?? and what BAN it will be given to my friend if he avail an AMNESTY Last Feb 2012>... but in the case he is not commit a criminal case. only an Immigration Ban because the employer is the one who give his BAN. Sir im working in hotel here in fujairah but i cannot mention the name. i am new here in this company. working for 1month and 2 weeks. i work before in sharjah before i came here. i signed the contract here with 2 year unlimited contract. they mention also in the contract about repartiation and NOC. but i dont idea what is that. Now i want to resign from here. But the manager in our hr told me that i will pay 6,000 AED plus 1 year ban. so sir im actually shocked about that. because of the amount is very big and i ask them why? they not take me from my previous company actually i go to them alone by taxi. they give for me a e-visa. and he told me that my e visa was 4,500 aed.       The most easiest way is to join any other free zone company in any emirates of UAE, this is the only way to protect your self from any ban.
      before joining new company ask new company to give you Offer Letter that will be needed to cancel your Hotel visa.

    I just want to ask regarding my son's status. He bought a maid's visa way back 2012 and entered UAE but unfortunately his sponsor didn't showed up nor stamp the visa in his passport or cancel it after taking his payment. So he decided to avail this amnesty 2012, after 3 days in the detention he went back home and had an irish scan/finger print. Now for almost 3 years, will he still be able to go back to UAE or any other GCC countries?

  35. hi good day.... its normal and legal if our company cut our salary because they told us they spend money when they hired us direct from philippines and we need to pay it back to the company??my friend need to pay 4100 drs ........and also me .they hired me last may 10 2014 but unfortunately i got problems in my medical so they filed my working visa last september 13 2014 and they told me i need to pay my extensions almost 2000 drs and they also cut it from my salary up to now i pay them 200 drs every salary ,,,is this legal and normal for our company??? please answer and thank you very much more power

    1. If the company offering you the job is a reputable one, you don't have to worry that there will be a discrepancy between the offer letter and the final contract.

      Once you arrived here, the final contract presented to you will be the one to be followed.
      Take note offer letter is just only an "offer", meaning it is still subject for any changes.

Hi i finish my contract in limited then i renew onother 2 years then i finish also and i passed them my one month notice but my employee he didnt cancelled my visa he said he will give me a banned because he said i didnt finish my one month notice but i did now we are in court if i lost the case i will have banned even though i finish my first 2 years contract

    1. I think if you lost your case, they can just give you a 6 months labour ban. Just dont lose all your important documents as a proof.

      Losing a case in any emirates of UAE against your employer (Company), leaving a Government Job before completing your Limited labour Contract or Violation of Terms and Conditions of your Labour Contract will put 1 year ban on you and you will not allowed to visit UAE until you finish 1 year Labour ban.

    1. Leave salary is must for any LLC company according to Employment Rules for UAE
      you are not responsible for contract, if they forget to write they should give you full annual salary (basic salary).

    I have a friend who is currently working in auh they were given a VISA under a specific company but theye worked in a different company,but the owner is the same person. Is that a legal process? In addition, they also let them work beyond their job description and position which is a burden as an employee because things should be done on time but due to other tasks they can't make it. For example, you worked as a telephone switch board operator and they verbally said that they will make you as a secretary and a personal assistant, is that a tolerable act of an employer??? will they be filed for a case???   75. Hi I would like to inquire. Our company as Semi Govt is growing in Abu Dhabi as well as Northern Emirates. And working hours is uncommon like 12hours for 4days and off for 4days. But most of us has owed hours to the company which we employees computed hours per month that we lack 5-6 duties of 12hours. Our company instead insisted that our owed hours ia doubled which is not stated in our employment contract. As responsible employee, we finished our owed hours while doing on call--still going on duty without pay- and promised us for Overtime pay. most of us listed for way negative owed hours yet we are compulsary to go on duty WITHOUR PAY :( is this legal? And is there anything we could do to have our over time pay? If we resigned with this reason, are we still going to have labour ban. Thanks. -your lifesaver

Many said i can't go back anymore because this disease will give you a lifetime ban and the problem i left many unpaid loan and credit cards because of this. Can i still go back and work there.       bank are searching you by now due to these unpaid loans and credit card, and will file a police report, if ever you landed here in UAE airport by chance even just a transit passenger, they will put you to jail.

    1. My friend you ca only avail free ticket if you finish your contract. What you can get after 1 year is the 11month pay w/c is equal to 1month salary and you can get 30 days leave.

That time he told me i will have 6 months ban but if i will come to him in Sharjah he will xfer my visa to his other business same sponsor...     1. your case is not Pneumonia, i think it is a primary complex tuberculosis. Pneumonia is treatable and doesn't warrant a BAN, while primary complex TB is treatable but will leave a TB scar in your lungs forever(inactive TB) which means you are a carrier, that's why you are on the ban list and no chance for you to remove it

Hi, I'm currently working in a private company located in abu dhabi business hub mussafa for more than one year now in an unlimitted contract. i just submitted my notice of resignation as i plan to return to my home country. my employer did not agree on the 30 days notice that i stated on my resignation letter and extended it to another 26 days making it 56 days in total. in addition to that, he mention that i will be banned for 3 years because the company is under the "Zonescorp". is this lawful that there is a 3 year ban for that area mentioned, i did't commited any offense, i just want to resign.

    1. In your case,since its not your fault for having a 6mos ban. If you anticipate the closing of a company atleast 3mos before the company or you should sbmit to labor a compliant that you will resign due to company will close soon and you shoulnt have a ban. but by the way, 6mos ban is no big deal, u can still transfer to another company and they will lift the ban using salary bracket scheme but there are lazy company that will not do it so carefull with choosing another employer.

Most people say renewal of contract even if only labor card that has been automaticallt renewed, my best advise is to check with MOL if you have existing NEW contract or just old contract and most cases ONLY labor card has been renewed not the contract coz you can still work at the same rules but if you finish your 3 years, you can leave safely without any labor/employment ban.

    1. As per the UAE employment law employees are not responsible for the company's financial liabilities and profit or loss. They are only responsible for their duties as agreed up on by the company in their employment contracts. If they fulfill their obligations as mentioned in their employment contracts, then, it is their right to receive their remuneration.
      If they are not giving you salary why should you didn't inform MOL about it?

I have finished my 2 years contract last year july 2014 and my company renewed my laborcard but not the employment contract and I will finish my 3 yrs now on july 2015 and I already submitted notice period not to renew my contract this MAY 2015 and lgal adviser said it is safe to leave this July 2015 without no labor ban or employment ban. But the question is do my company will force me to put 6mos employment ban even legal advised told me to submit non renewal letter that will end this July 2015. For all those guys having the same problem that they finish 2 yrs and renewed, kindly check ur contract to labor and if they didnt see ur new contract it mins ur just been extended and use the old contract but ur laborcard will be automatically renewed.

Police test him in medical that any sexual contract happen or not. He didn't do any thing like that. So on Sharjah court he n his gf face 3 month jail n deportation.       Your friend will be face Immigration ban and if his contract was not finished may be he only face 1 Year labour ban ( if he Lucky)
      otherwise he will face Immigration ban because of inappropriate relationship and he can not enter any GCC Country more.

  105. Good Day to the author of this blog. I need an advise because I think I'm in a critical situation. I was working for an agency and they send me to a retail client. Now both my Labour Card(23-Mar-2015 expiry date) and Residence Visa(23-Apr-2015 expiry date) are already expired, and now I'm on my grace period with 17 days left on it. The scenario is the client terminated their project on our agency and affect my work. Then the HR send me a termination letter indicating that my last day of work is 30-Apr-2015 (due to the client's project termination to the agency) but from the client my last day of work is 03-Mar-2015. Now, I found a new company to join with and waiting for my documents to pass. I'm sending an e-mail, SMS and even phone call to the HR of our agency to follow-up my cancellation. Then yesterday I tried to call him again and he picked up the phone and asked him regarding my cancellation but he told me that they still need the e-mail from the client and someone will call me. I asked him until when should I wait because my grace period will be done and I need to pay penalty after that he shouted at me "not to call him again for the cancellation". Take note that every time I'm sending an e-mail to our HR he is not replying and updating me regarding my cancellation. After the call I send an e-mail to the client regarding my cancellation and cc to our HR.

    I have one more problem, anytime soon my wife is giving birth to our first baby here in Dubai but the thing is how can I apply visa to my baby if I'm not cancelled which my visa is under in Sharjah.

    Sorry for the long post but I really need your advise as soon as possible and which action should I take as I am very worried not only for me also for my family.Thank you in advance and more power for the author.

      The best to live here is to find another job before applying termination.
      If you found a job in LLC Company you will need termination letter from current company and an offer letter from new company to avoid ban
      You will be lucky if you found a Free zone job, No ban will be on you after getting Free zone visa even if your contract is not completed.

    1. Sorry yhummie you did really big mistake, inappropriate relationship is strictly prohibited here in UAE, you will face Immigration ban, and may be a labour ban as well for 1 year,
      You can enter UAE only on Tourist Visa, but before entering please count 360 days for 1 year Labour ban.

Sir, i done my 5 years contract and now working in new company with 2 years contract. 1 year and six months now i finished it with the current salary of 3,000aed and got the new offer of 5,100aed. I have higher secondary certificate with uae athested.Can i join the new company without banned?

    1. Yes of course you can join but You have to take resignation letter from current and Offer letter from new company with 5000 above salary to avoid ban.

Hi good day!! i am currently working in unlimited visa here for 6years and 10 months now in one company which is no medical insurance and health card since our work is in a field of construction,our main company was base is on Saudi they have branch here which is i'm working now they decided to separate it and sell to our manager here he will be the owner of the new company regarding our service pay or gratuity they told that it will be continious once we sign in a new contract in his company it is legal to labor law.? or if we decide not to sign in new contract to his new company we will have a ban? thank you and more power!!!

  122. Hi. I am working in my company from 4 months ago in unlimited contract amd paid 10K per month and I got new offer from a competitor company as higher salary above 12K.
    Note: there is a mentioned clause in contract which state that is not allowed to work in competitor company for 2 years

Hi, I'm currently working in a private company located in abu dhabi business hub mussafa for more than one year now in an unlimitted contract. i just submitted my notice of resignation as i plan to return to my home country. my employer did not agree on the 30 days notice that i stated on my resignation letter and extended it to another 26 days making it 56 days in total. in addition to that, he mention that i will be banned for 3 years because the company is under the "Zonescorp". is this lawful that there is a 3 year ban for that area mentioned, i did't commited any offense, i just want to resign.

  128. Hai admin..I work in dubai as a housmaid at British family I run away from my employer..
    possible my employer can put me a lifetime bann???
    But I avail amnesty last 2012 to came back my home country..now almost 2yrs that happen ..is theres any option,way or chance to come DUBAI again???

  130. Sir , my work permit visa has been rejected twice in year 2012 & 2013 respectively. I was selected in govt. Oil company.Company did not provide any specific reason for visa rejection. It is still mystery for me. I jave never entered UAE or any GCC country earlier though work permit visa has been rejected. Is there any reason ? Can you pleass guide me?

Hi sir/mdm ..my father's company not give him passports than he mak case in court.the court gived him passport but the visa was not renewed he type for labour for cancellation labour cancil his visa whil he pay fins and mak for him ban 1 year when he go for emigration he had heavy fins he cant pay immigration ask him to bring tiket .after thy said life time ban .so can is possible this?? Plz I need information

  135. Good day! I woukd sincerely appreciate your response regarding my query. My co-worker is under limited contract in a hotel here in abu dhabi. after 6 months, she was accepted in a sheikh-owned hotel (if i am not mistaken). Though rendering 30-day period upon resignation was not needed as she was on limited contract, she did serve it anyway.

    Now, it's almost 3 months and the employer has not cancelled her visa yet. she's staying here without any income. she already went to MOL and also to the courts and filed a case. Unfortunately, the people in the court gave her wrong info on the date of the judgment day. the judgment day was April 21 bit she was told it was April 29. since she appeared on thr 29, she found out that the case had been cancelled bec she was not there on the 21st.

    She is willing to pay the 45-day salary to the employer. Is there any other way that this case could be expedited? Is there any case that could be filed against the employer for not cancelling her visa since Feb that she suitted her resignation?
